Samman Tiranga Foundation ("we", "us" or "our") respects your privacy and is committed to protecting your personal data. This policy explains what we collect, why we collect it, how we use and protect it, how long we keep it, and what rights you have.

This policy is written to align with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and rules made under it. It applies to this website and to any personal data you provide to us through it.

1. Who We Are (Data Fiduciary)

For the purposes of the Digital Personal Data Protection Act, 2023, Samman Tiranga Foundation is the Data Fiduciary responsible for your personal data.

2. Personal Data We Collect

We only collect data that we actually need in order to run our programmes. What we collect depends on how you interact with us.

  • Flag Exchange request: your name, email address, phone number, full pickup address, city, PIN code, the condition and quantity of flags, any notes you add, and photographs you choose to upload.
  • Contact form: your name, email address, phone number, subject and message.
  • Volunteer / Join Us form: your name, email address, phone number, city, the role you wish to join as, and your message.
  • Event registration: your name, email address, phone number, number of guests and any notes.
  • Membership: your name, contact details and delivery address, together with the membership record created on successful payment.
  • Donations: your name, contact details, donation amount, and the transaction reference returned by the payment gateway.
  • Shop orders: your name, contact details, shipping address, order contents and the transaction reference.
  • Story submissions: any content, images and attribution details you choose to send us.
  • Technical data: your IP address is processed transiently by our server for security and rate limiting (see section 5). Standard web server logs may record request details.

We do not knowingly collect sensitive personal data such as caste, religion, political affiliation, health or biometric information, and we ask that you do not send such information to us.

3. Payment Information — What We Never See

Payments are processed by Razorpay, an independent third-party payment gateway. Your card number, CVV, expiry date, UPI PIN and net-banking credentials are entered directly into the gateway's own secure interface.

We never receive, process or store your complete payment instrument details on our servers. What we retain is limited to the gateway's order and payment reference identifiers, the amount, and the payment status — enough to reconcile your contribution and to answer a query about it.

Razorpay processes your payment data as an independent controller under its own privacy policy, which we encourage you to read.

5. Cookies, Local Storage and Tracking

This website does not use advertising cookies, third-party analytics trackers, or cross-site tracking pixels.

We use your browser's local storage to remember your shopping cart, wishlist, and a local copy of any flag exchange request you submit, so those persist between visits on your own device. This information stays in your browser and is not transmitted to us as a tracking signal.

The admin panel uses a strictly necessary session cookie so that authorised staff stay logged in. It is marked HttpOnly, Secure and SameSite=Strict, and it is not used for any tracking purpose.

Some pages embed a Google Map. When such a page loads, Google may set its own cookies and receive your IP address under its own privacy policy. If you prefer to avoid this, you can choose not to visit those pages or block third-party content in your browser.

You can clear local storage and cookies at any time through your browser settings. Doing so will empty your cart and remove locally saved request records.

6. Who We Share Data With

We share personal data only where it is necessary to deliver a service or to comply with the law, and always on a need-to-know basis.

  • Payment gateway (Razorpay) — to process your donation, membership or purchase.
  • Hosting provider — our website and database are hosted on shared hosting infrastructure; the provider may technically have access to stored data in the course of maintaining the service.
  • Delivery and logistics partners — where a physical pickup or dispatch is required, we share the name, address and phone number needed to complete it.
  • Email delivery — confirmation and notification emails are transmitted through our hosting provider's mail service.
  • Professional advisers and auditors — where required for accounting, audit or legal advice, under a duty of confidentiality.
  • Public authorities — where we are required to disclose by law, court order, or a valid request from a law enforcement or regulatory body.

We do not share your personal data with any other organisation for their own marketing or commercial purposes.

7. How Long We Keep Your Data

We keep personal data only for as long as it is needed for the purpose it was collected for, or for as long as the law requires.

  • Flag exchange requests: retained while the request is active and for up to 3 years afterwards, so we can answer follow-up queries and report on programme delivery.
  • Contact messages and volunteer enquiries: up to 2 years from your last contact with us.
  • Donation, membership and order records: retained for at least 8 years, as required by Indian accounting, tax and audit rules.
  • Security and rate-limiting records: automatically deleted within 24 hours.
  • Story submissions published on the website: retained while published, and archived thereafter unless you ask us to remove them.

8. How We Protect Your Data

We take the security of your data seriously and apply technical and organisational measures appropriate to the risk.

  • All traffic to this website is encrypted in transit using HTTPS, and HTTP requests are redirected to HTTPS.
  • All database access uses parameterised queries, which prevents SQL injection.
  • Administrative access is protected by password hashing, login rate limiting and account lockout, session timeouts, session binding, and CSRF protection on every form.
  • Public forms and lookup endpoints are rate limited to prevent scraping, brute force and abuse.
  • The flag exchange tracker returns only a masked name, and tracking codes are generated using a cryptographically secure random source so they cannot be guessed or enumerated.
  • Uploaded files are validated by content, renamed, and stored in a location where they cannot be executed.
  • Security response headers, including a Content Security Policy, are applied across the site.
  • Credentials are stored outside version control and are never exposed to the browser.

No method of transmission or storage is completely secure. While we work hard to protect your data, we cannot guarantee absolute security, and you share information with us at your own risk.

9. Your Rights

Under the Digital Personal Data Protection Act, 2023 you have the following rights in relation to your personal data.

  • Right to access — obtain a summary of the personal data we hold about you and how we are processing it.
  • Right to correction — have inaccurate or misleading data corrected, and incomplete data completed.
  • Right to erasure — ask us to delete personal data that is no longer needed for the purpose it was collected for, subject to our legal retention obligations.
  • Right to withdraw consent — withdraw your consent at any time, as easily as you gave it. Withdrawal does not affect processing already carried out.
  • Right to grievance redressal — raise a complaint with us about how we handle your data (see section 12).
  • Right to nominate — nominate another individual to exercise your rights on your behalf in the event of your death or incapacity.

To exercise any of these rights, email us at sammantiranga@gmail.com with enough detail for us to identify your records. We will respond within 24-48 business hours, and in any event within the period required by law. We may need to verify your identity before acting on a request.

10. Children's Data

Our services are directed at adults. We do not knowingly collect personal data from children under the age of 18 without the verifiable consent of a parent or legal guardian.

We run awareness programmes in schools. Where children participate, we work through the school and rely on the school and parents or guardians for the necessary consents, including for any photography.

If you believe a child has provided us with personal data without appropriate consent, please contact us immediately and we will delete it.

11. Data Location and Transfers

Our website and database are hosted on servers provided by our hosting partner. Some service providers we rely on, such as the payment gateway and email delivery, may process data on infrastructure located outside India.

Where data is transferred outside India, we take reasonable steps to satisfy ourselves that appropriate safeguards are in place, and such transfers are made in accordance with applicable Indian law.

12. Grievance Officer

If you have a concern or complaint about how we handle your personal data, please contact our Grievance Officer. We take every complaint seriously and will investigate it properly.

We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days. If you remain dissatisfied, you have the right to escalate the matter to the Data Protection Board of India.

13. Data Breach Notification

In the event of a personal data breach, we will assess the incident promptly, take steps to contain and remedy it, and notify the Data Protection Board of India and affected individuals as required by applicable law.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, our services or the law. The current version is always published on this page with the 'Last updated' date shown at the top.

Where changes are significant, we will take reasonable steps to bring them to your attention. Please review this page periodically.
